General Terms and Conditions

Effective 1 January 2026 — Swiss law applies.

Art. 1 — Scope

These General Terms and Conditions (GTC) govern all bodywork, painting, glazing, polishing, tyre storage and related services provided by Ideal Car, a sole proprietorship operated by Mr Turgut Yasar, Route du Mandemant 15, 1217 Meyrin (hereinafter "the Workshop").

Handing over a vehicle to the Workshop or accepting a quote constitutes unconditional acceptance of these GTC. Specific written conditions may override these GTC and shall take precedence where they conflict.

Art. 2 — Quotes and Orders

All quotes issued by the Workshop are free of charge and valid for 30 days from the date of issue. They are based on a visual inspection of the vehicle; additional work may be required once parts are disassembled. The Workshop will notify the client promptly and obtain approval before proceeding.

An order becomes binding upon the client's signature of the quote or, in the absence of a signature, upon handover of the vehicle to the Workshop.

Art. 3 — Pricing and VAT

All prices are quoted in Swiss francs (CHF), inclusive of VAT at the applicable rate (currently 8.1% for services). Should the statutory VAT rate change between the quote date and the invoice date, the VAT-inclusive price will be adjusted accordingly.

Spare parts billed separately are shown exclusive of VAT on the quote and taxed at the rate applicable to their category (goods or services).

Art. 4 — Payment Terms

The invoice is payable in full upon collection of the vehicle, unless otherwise agreed in writing. Accepted payment methods: cash, bank transfer, debit/credit card (Visa, Mastercard) and TWINT.

Any payment outstanding beyond 30 days will automatically attract default interest at the Swiss statutory rate (5% per annum). The Workshop reserves the right to retain the vehicle until the invoice is paid in full (right of retention — Art. 895 CC).

Art. 5 — Lead Times

Any lead times communicated to the client are indicative. The Workshop undertakes to inform the client of any foreseeable overrun. Delays may be extended due to force majeure, unavailability of parts, adverse weather or unforeseen circumstances beyond the Workshop's control.

An indicative deadline does not entitle the client to damages unless a binding written commitment has been made.

Art. 6 — Vehicle Handover and Collection

The client must collect their vehicle within 5 working days of being notified that work is complete. A storage fee of CHF 15.– per day may be charged thereafter.

On collection, the client is invited to inspect the completed work in the presence of a Workshop representative. Any reservations must be noted on the handover document; subsequent complaints will only be considered if they relate to defects that were not visible at the time of collection.

Art. 7 — Warranties

Work carried out by the Workshop is warranted as follows:

  • Bodywork and paint: 2 years from the date of vehicle collection.
  • Glazing (replacement): 1 year on the installation; the manufacturer's warranty applies to the glass itself.
  • Polishing and renovation: 6 months on the result, subject to normal vehicle maintenance.
  • Spare parts: manufacturer's warranty passed on to the client.

The warranty is void in cases of normal wear and tear, poor maintenance, accident, unauthorised modification or third-party intervention after collection.

Art. 8 — Liability

The Workshop holds professional liability insurance covering damage to vehicles in its care. Its liability is limited to the market value of the vehicle at the time of the incident. Valuables left in the vehicle are not covered; clients are advised to remove them before handover.

The Workshop accepts no liability for indirect or consequential losses (loss of earnings, cost of a replacement vehicle not agreed in writing, etc.).

Art. 9 — Insurance Claims

Ideal Car is approved by the leading Swiss insurance companies. In the event of an insured claim, the Workshop may handle the administrative process with the client's insurer, acting under the client's express written authorisation. The client remains responsible for paying the excess and any amounts not covered by the policy.

Art. 10 — Data Protection

Personal data collected (name, contact details, vehicle information) is processed in accordance with the Swiss Federal Act on Data Protection (revDSG) and the GDPR for EU residents. It is used solely for the purposes of managing services, invoicing and work-related communication.

Data is not shared with third parties without the client's consent, except with insurance companies under a signed authorisation. Clients have the right to access, correct or delete their data by contacting ideal.car76@yahoo.com.

Art. 11 — Applicable Law and Jurisdiction

These GTC are governed by Swiss law, in particular the Code of Obligations (CO). Any dispute concerning their interpretation or performance shall be subject to the exclusive jurisdiction of the courts of the Canton of Geneva, without prejudice to any mandatory rules applicable at the consumer's place of domicile.

Art. 12 — Amendments

The Workshop reserves the right to amend these GTC at any time. The applicable version is the one in force on the date the vehicle is handed over or the quote is accepted.
